ABSTRACTFor ten years, General Motors denied that an ignition switch that could easily be turned to ‘Off’ constituted a safety defect. Accidents, deaths and injuries resulted. Despite many, many suits against GM, the problem remained uncorrected. The explanations that have been proffered are interrogated in this article and others are suggested. It concludes that a bureaucratic legal department is partly to blame, and criticises how the legal department evaluated cases by their settlement value. It criticises GM’s culture of blaming drivers (...) for accidents. It concludes that the main problem at GM was not bureaucracy, but poor organisation of team management. GM was not organised for accountability without hierarchy. The article suggests that lawyers can play a key role in improving corporate decision making. (shrink)

A legislação florestal brasileira pretérita é frequentemente interpretada de forma anacrônica. O objetivo deste artigo é contribuir para a compreensão da historicidade de tal legislação. De forma específica, serão analisadas, comparativamente, as propostas de alteração do primeiro Código Florestal Brasileiro até sua substituição em 1965. Apesar de modificações importantes, há uma permanência entre os textos analisados: as posturas conservacionistas, presentes em todos eles, só podem ser compreendidas quando atreladas à lógica produtivista e às políticas desenvolvimentistas evidenciadas no Brasil da época.

Marcel Beaufils fut un pedagogue exceptionnel qui exerca une influence decisive sur l'evolution de l'esthetique musicale en France, a partir des annees 50. Or, parmi ses ouvrages, Musique du son, musique du verbe est tres certainement celui qui porte le plus fortement la marque de son activite d'enseignant au Conservatoire National Superieur de Musique de Paris ; cette mission, il semblait l'entendre davantage comme celle d'un declencheur d'idees, catalyseur, plutot que du transmetteur d'un savoir fige une fois pour toutes. Bouleversant (...) toute tentative de classification academique, toute certitude acquise, ce livre laisse des pointilles ; un grand souffle traverse son ecriture. N'en deplaise aux musicographes, il s'agit la d'un ouvrage de creation, qui nous rappelle que Marce Beaufils etait egalement un ecrivain qui savait manier le verbe a la fois en tant que dramaturge et en tant que poete. Resumo: A partir da disseminação das políticas educacionais inclusivas observa-se um aumento de matrículas de estudantes em situação de deficiência no Ensino Superior, elegíveis aos serviços de Educação Especial, no Brasil. Este artigo objetiva analisar os critérios institucionais utilizados para delinear o perfil desses universitários nos dados Censitários da Universidade e, de que modo tais dados comungam com as políticas educacionais inclusivas vigentes. Por conseguinte, buscará compreender como as políticas institucionais da universidade se correlacionam com as do Censo do Ensino (...) Superior e Políticas Educacionais Inclusivas no que refere aos apoios e medidas protetivas de acesso e participação dos estudantes a esta etapa de ensino à população mencionada. Trata-se de um estudo documental balizado na descrição do perfil de universitários da graduação e de pós-graduação, de uma universidade pública paulista no a) anuário institucional, b) formulário de identificação de matrícula de estudantes e, c) das designações desta população, descrita no Censo do INEP. Os resultados demonstraram um descompasso na caracterização dos marcadores que retratam o perfil do público em relação as designações referenciadas na Lei Brasileira de Inclusão. A escassez de práticas institucionais inclusivas dirigidas a este tema, somadas a falta de clareza na compreensão sobre as demandas educacionais específicas, declaradas pelos estudantes contribuem para manter um clima de instabilidade das tratativas de respostas à permanência deste público na universidade investigada. Policy for the identification of students with SEN at a public Brazilian university Abstract: From the dissemination of inclusive educational policies, there is an increase in enrollment of students with Special Educational Needs (SEN) in Higher Education, users of Special Education services, in Brazil.The article aims to analyze the institutional criteria used to delineate the profile of these university students in the University's Census data and how these data are in line with the current inclusive educational policies. Therefore, it will seek to understand how the university's institutional policies correlate with those of the Higher Education Census and Inclusive Educational Policies regarding support and protective measures to access this stage of education for the population mentioned. This is a documentary study based on the description of the profile of undergraduate and graduate students, of a public university in São Paulo in a) institutional yearbook, b) student enrollment identification form, and c) the designations of this population, described in the INEP Census. The results demonstrated a disparity in the characterization of the markers that portray the public's profile in relation to the designations referenced in the Brazilian Inclusion Law. The shortage of inclusive institutional practices aimed at this theme, added to the lack of clarity in understanding about the especific educational demands, declared by students at the time contribute to maintaining a climate of instability in the treatment of responses to the permanence of this public in the investigated university. Política para la identificación de estudiantes con NEE en una universidad pública brasileña Resumen: El artigo tiene como objetivo analizar los criterios institucionales utilizados para delinear el perfil de estos estudiantes universitarios en los datos del Censo de la Universidad y cómo estos datos están en línea con las políticas educativas inclusivas vigentes. Por lo tanto, le interesará comprender cómo las políticas institucionales de la universidad se correlacionan con las del Censo de Educación Superior y las Políticas Educativas Inclusivas en cuanto a medidas de apoyo y protección para el acceso a esta etapa educativa para la población mencionada. Se trata de un estudio documental basado en la descripción del perfil de estudiantes de grado y posgrado, de una universidad pública de São Paulo en a) anuario institucional y b) formulario de identificación de matrícula y, c) las designaciones de esta población, descritas en Censo del INEP. Los resultados demostraron un desajuste en la caracterización de los marcadores que retratan el perfil del público en relación a las designaciones referenciadas en la Ley de Inclusión brasileña. La escasez de prácticas institucionales inclusivas dirigidas a esta temática, sumada a la falta de claridad en la comprensión de las demandas educativas especificas, declaradas por los estudiantes al momento de su ingreso y / o matrícula, contribuyen a mantener un clima de inestabilidad en el tratamiento de respuestas a la permanencia de este público en la universidad investigada. A reading of Kant’s viewpoint on objectivity is suggested that finds inspiration in the second part of the third Critique, on living systems. It develops the idea that the need to articulate the distinction between objectivity and subjectivity only emerges to the extent that something resists the anticipative procedures of a living, actively engaged being. The possibility of objective knowledge, so it is argued, rests on the possibility of developing an adequate orientation in a phenomenal world, i.e., the possibility of (...) actively distinguishing an “outside” from an “inside”—this not on the basis of an a priori principle, but by taking into account the punctual resistances and disappointments that appear within contingent encounters leading to pleasure and displeasure. We consider negation as a constitutive factor in the emergence of this very basic distinction, as well as in more elaborate and complex differentiations between objectivity and subjectivity. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

Norman tries to link the ecological and constructivist approaches to the dorsal and ventral pathways of the visual system. Such a link implies that the distinction is not only one of approach, but that different issues are studied. Norman identifies these issues as perception and action. The influence of contextual illusions is critical for Norman's arguments. We point out that fast (dorsal) actions can be fooled by contextual illusions while (ventral) perceptual judgements can be insensitive to them. Sous le terme technique de complexe significabile se trouve abordee la question du signifiable par complexe, c'est-a-dire du signifie de la proposition et de son statut objectif. L'ouvrage propose ainsi une double approche de la notion de signification et de ses rapports a la reference ontologique: l'analyse classique depuis Gregoire de Rimini a Leibniz, les (...) points de vue contemporains tels que Meinong ou Russell. Poverty observed from business in the academic field has evolved in some publications and is characterized as a multidimensional phenomenon, having several theoretical strands that add their attention to this problem. The objective of this study is to identify and cluster the variables of poverty in the business area through the network analysis. There were 1,745 keywords mentioned in 566 papers about the theme present in the Scopus database between 2000 and 2016. The results demonstrate a network with four clusters: (...) (a) Economy, government and people; (b) Community, institutions and market; (c) Business and environment; and (d) Social aspects and finance. From the network, it is possible to understand the most cited categories of variables (research methodology and business aspects), the most consolidated relations between categories of variables (poverty and economic aspects), the most studied area (Economy, government and people), and the gaps to be explored. Einstein Versus Bohr is unlike other books on science written by experts for non-experts, because it presents the history of science in terms of problems, conflicts, contradictions, and arguments. Science normally "keeps a tidy workshop." Professor Sachs breaks with convention by taking us into the theoretical workshop, giving us a problem-oriented account of modern physics, an account that concentrates on underlying concepts and debate. The book contains mathematical explanations, but it is so-designed that the whole argument can be followed with (...) the math omitted. Professor Sachs' story begins with classical and nineteenth century physics, describes the early discoveries in particle theory, and introduces the "old" quantum theory, which evolved into the quantum mechanics of the Copenhagen School. Such important ideas as the Einstein Photon Box experiment and the Einstein-Podolsky-Rosen Paradox, and Schrodinger's Cat Paradox are clearly expounded, followed by a completely fresh explanation of relativity in conceptual terms, showing how apparent paradoxes can be removed by Einstein's own interpretation, especially that of his later years. Professor Sachs gives a detailed comparison of the fundamentals of the quantum and relativity theories, suggesting how the contradictions might be resolved. In an epilogue, he makes suggestions, with reference to religious notions, Taoism, and Buber's theory of I-Thou, for generalizing Einstein's approach beyond physics. (shrink)

De nombreux auteurs décrivent le temps comme un facteur déterminant à l’égard de la guerre. Cela vaut particulièrement pour les guerres asymétriques, à propos desquelles le temps favoriserait le faible. Quant aux démocraties, leurs chances de victoire diminueraient à mesure que la guerre dure dans le temps. La guerre étant un processus complexe, il est délicat de déterminer avec précision quels sont les facteurs qui en déterminent l’issue. Les observateurs se trouvent alors dans une situation d’incertitude. S’ils parviennent à identifier (...) certaines tendances, il leur est difficile d’isoler les facteurs pertinents. Par conséquent, plutôt que de démêler ce nœud de facteurs, ils préfèrent parfois affirmer que le temps en est un lui-même. Ici, le temps n’est rien d’autre qu’un concept par défaut. En réalité, il ne joue pour personne. Il n’est pas un facteur de la guerre, mais une dimension à l’intérieur de laquelle les facteurs opèrent. Des confusions majeures sont faites par les auteurs.. En este artículo discuto una nueva aproximación al concepto de teología política. Mi propuesta es que al incluir la perspectiva ecofeminista se abren nuevas miradas para abordar la discusión de la teología política, que se ha caracterizado por una dominación geográfica, androcéntrica y antropocéntrica en el estado del arte sobre la teología política y su relación con la soberanía. El artículo se articula a partir de ideas planteadas por la teología ecofeminista de Ivone Gebara y Mary Judith Ress en el (...) contexto latinoamericano. Para finalizar, planteo el caso del colectivo Con-spirando como una posibilidad política de acercarnos a nuevos modos de abordar el concepto de teología política. (shrink)

Jérusalem, livre majeur de Moses Mendelssohn, est une apologie du judaïsme. Apologie dans le sens de Socrate : sommé de répondre aux accusations des hommes de la cité, Mendelssohn, le " Socrate de Berlin ", doit répondre de soi. Peut-on être juif et éclairé à la fois? Le juif des Lumières est-il pensable? Peut-il exister? Face à la critique moderne du judaïsme - celle qui trouve sa formulation la plus accomplie dans le Traité théologico-politique de Spinoza -, Mendelssohn formule une (...) réponse fondamentale, inaugurant ainsi la pensée juive moderne. Entendre cette réponse nécessite une lecture attentive de Jérusalem. Inspiré par la leçon de Franz Rosenzweig et d'Emmanuel Lévinas, et dans le sillage de l'enseignement de Benny Lévy, L'Apologie de Mendelssohn tente une telle lecture. Lecture sensible au retour à Platon s'opérant discrètement dans le penser de Mendelssohn : le Platon dialoguant, celui attaché à la vérité d'existence plutôt qu'à l'exactitude mathématico- logique. Mais lecture sensible aussi au retour à la sagesse des maîtres d'Israël qui s'opère nettement au sein de Jérusalem. Sagesse qui sait penser le commandement divin non pas comme loi politique mais comme possibilité singulière d'accorder vie et vérité. Sagesse permettant ainsi de repenser le sens de l'élection d'Israël et son rapport à l'universalisme. Mendelssohn a-t-il su rester fidèle à l'enseignement des maîtres d'Israël? A-t-il pu accorder jusqu'au bout élection et universalisme? Question ultime que pose L'Apologie de Mendelssohn, permettant enfin d'examiner les limites qu'il impose à la pensée juive dans son oeuvre. In Mortal Imitations of Divine Life, Diamond offers an interpretation of De Anima, which explains how and why Aristotle places souls in a hierarchy of value. Aristotle’s central intention in De Anima is to discover the nature and essence of soul—the prin­ciple of living beings. He does so by identifying the common structures underlying every living activity, whether it be eating, perceiving, thinking, or moving through space. As Diamond demonstrates through close readings of De Anima, the nature of the soul (...) is most clearly seen in its divine life, while the embodied soul’s other activi­ties are progressively clearer approximations of this principle. This interpretation shows how Aristotle’s psychology and biology cannot be properly understood apart from his theological conception of God as life, and offers a new explanation of De Anima’s unity of purpose and structure. Este manifesto, escrito a quatro mãos no contexto de um colóquio sobre Bergson organizado no Japão, visa inicialmente responder a uma simples questão: que significa, hoje, trabalhar à maneira de Bergson? Não se trata de uma pergunta sobre a dedicação para com o corpus bergsoniano ou quanto a certos temas que o seu pensamento permite renovar a compreensão, mas sim sobre o método que ele próprio recomenda. Este método foi aplicado diligentemente por Bergson no curso de suas investigações, particularmente quanto (...) ao seu trato com as ciências positivas, tanto as da vida quanto às do universo material em sentido amplo. No que diz respeito à função da imaginação metafísica, este manifesto refaz os passos de Bergson quanto a um empirismo não especulativo e verdadeiramente contemporâneo à inteligência científica.
